ESA Regulations & Procedures For Appeals

Please note the new Rules of Procedure for Reviews and Appeals (the Rules of Procedure) will come in effect on August 1, 2019. The Rules of Procedure set out what you need to know or do when you are disputing an ESA Order or Notice of Proposal.

The Rules of Procedure apply immediately to all Director’s Reviews, Director’s Hearings and Appeals to the Review Panel, even if the case started before August 1, 2019.

Rules of Procedure for Licences

The purpose of the Rules of Procedure is to provide clear and consistent policies for filing an appeal with the Director of Appeal and for a hearing before the Director or Review Panel.

The Act and Regulations

Electricity Act, 1998

This Act establishes ESA’s responsibility for regulating the safe use of electricity and equipment in Ontario, enforcing the Ontario Electrical Safety Code, and appointing inspectors.

Safety and Consumer Statutes Administration Act, 1996

This Act establishes the legal framework for ESA’s operation as an Administrative Authority.

Statutory Powers Procedure Act

This Act establishes the rules that govern procedures and rule-making by tribunals.

Ontario Regulation 22/04

Electrical Distribution Safety
Establishes objective based electrical safety requirements for the design, construction, and maintenance of electrical distribution systems owned by licensed distributors. The regulation requires the approval of equipment, plans, specifications and inspection of construction before they are put into service, but provides local distribution companies with a number of options to obtain these approvals.

Ontario Regulation 89/99

Electrical Safety Authority
This regulation designates ESA as the sole administrative authority for the purposes of Part VIII under the Electricity Act, 1998 and regulations made there under.

Ontario Regulation 164/99

Electrical Safety Code
This regulation adopts, by reference, the Canadian Electrical Code together with specific Ontario amendments and is referred to as the Ontario Electrical Safety Code (OESC). The OESC is a technical document that outlines the standards for electrical installations.

Ontario Regulation 187/09

Reviews/Appeals of ESA Orders & Appeal of Director’s Decision on Licenses
Establishes the rules for reviews and appeals submitted before the Director or Review Panel regarding orders issued by the ESA and Director’s decision on Licences under part VIII of the Electricity Act, 1998

Ontario Regulation 570/05

Electrical Product Safety
Provides ESA with greater ability to deal with the safety of electrical products and equipment sold and used in Ontario. A link to amended Regulation 438/07 will be provided once available.

Licensing of Electrical Contractors and Master Electricians
This regulation sets out the requirements for the Provincial Licensing of Electrical Contractors and Master Electricians.

Ontario Electrical Safety CodeOntario Electrical Safety Code is primarily a technical document and it is prescriptive in approach. The Ontario Electrical Safety Code describes the standards for electrical installations in detail.
